VISA Prediction on EB-2, EB-3, EB-5 for Chinese Nationals:

| January 16, 2015 | 0 Comments

In an interview with the American Immigration Lawyers Association, February 2015, Charlie Oppenheim of the Department of State predicted that EB2 China will advance by another 3 to 6 weeks in the coming months, while EB3 China will experience rapid forward movement. The priority date for EB3-China will be more than 17 months ahead of EB2- China.

Mr. Oppenheim further expects that a sharp increase in EB3 China demand will prompt corrective action before the date advances that far. He cautioned attorneys and their clients against relying on sources other than the State Department’s official data and predictions, noting he has seen incorrect and misleading information in blogs.

Mr. Oppenheim continues to expect it will be necessary to establish an EB5 China cutoff date no later than this summer. The Visa Office is closely monitoring demand and is gathering data from USCIS and the consular post in Guangzhou. As stated previously, Mr. Oppenheim expects the retrogression to be significant, with a cutoff date in summer 2013 being the worst case scenario.
