Franchise Investment for EB-5

 

One in twelve businesses in the United States is a franchise, with over 600,000 businesses generating over $950 billion dollars in annual sales. Pursuant to State law, a franchise must register its updated Disclosure Statement with the State of California. These disclosure statements must meet specific Franchise Law  requirements, providing financial, operational, and other detailed information. However, registration with the State does not mean the contents (such as financials) of the statement was evaluated and approved by the State. An experienced law firm must analyze the statement, conduct site inspections and conduct multiple interviews, to complete the due diligence process.

The superior benefit of franchise businesses in the immigration setting, is a proven system with corporate support and training. Compared to “Regional Center” investment that many law office promote, which involves the uncertainty, delays, and the unpredictable nature of expenses in constructing Regional Centers, franchises offer significant advantages and a significantly higher probability of success. First and foremost, a lawyer’s mission is to advance the best interest of his clients. Why would any lawyer recommend an avenue of investment that only has a 10% success rate?  The answer is unfortunately very simple. Most immigration lawyers consider the practice of immigration law as the simple filing of government forms, and that they are “only the immigration lawyer.” They believe the business side of the investment is not their responsibility, and the client is left to manage their own investment. What those lawyers fail to recognize, is their moral responsibility to treat their client’s money as precious as life itself.  After all, clients worked extremely hard through countless personal sacrifice and dedication, to accumulate the wealth necessary for an opportunity to become a citizen of the United States. Furthermore, if the investment venture fails, and it fails to satisfy the EB-5 requirements, their clients will have lost the investment money and also be denied a green card. This is unfortunately, often the case since most immigration lawyers do not have the necessary business and litigation background to manage business investments properly. In short, lawyers that do not know how to utilize a franchise are forced to steer their clients to Regional Centers, an avenue of investment with a staggering 90% failure rate.
